1. Acceptance of Terms

By downloading, installing, or using the Gurby mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Gurby ("we," "our," or "us").

2. Description of Service

Gurby is a mobile application designed to help expats navigate the process of settling in the Netherlands. The App provides:
  • Checklists and guides for administrative tasks (BSN registration, housing, healthcare, banking, etc.)
  • Progress tracking for completed tasks
  • General information about Dutch bureaucracy and regulations
  • A community platform to discover, connect with, and communicate with other expats in the Netherlands
  • A social feed where users can share experiences, ask questions, and engage with community content through posts, comments, and reactions
  • In-app notifications about community activity such as contact requests, reactions to your posts, and comments

    THE APP PROVIDES GENERAL INFORMATION AND GUIDANCE ONLY. IT DOES NOT CONSTITUTE LEGAL, FINANCIAL, TAX, MEDICAL, OR PROFESSIONAL ADVICE. The information in the App is provided for educational and informational purposes. You should always verify information with official Dutch government sources and consult qualified professionals for advice specific to your situation.

    3. Eligibility

    You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. If we learn that a user is under 13 years of age, we will promptly terminate their account and delete their data.

    If you are between 13 and 18 years of age, you represent that you have your parent's or legal guardian's permission to use the App.

    4. User Accounts

    4.1 Account Creation

    The App initially creates an anonymous account to provide basic functionality (checklists and guides). To access community features — including viewing profiles, sending contact requests, and connecting with other users — you must sign in with Google or Apple.

    4.2 Account Security

    You are responsible for:
  • Maintaining the security of your device and account credentials
  • All activities that occur through your use of the App and your account
  • Ensuring any information you provide is accurate, current, and not misleading
  • Notifying us immediately if you suspect unauthorized use of your account

    • 4.3 Account Deletion

    You may delete your account at any time from within the App (Settings > Delete Account). Account deletion permanently removes all your data, including your profile, contact requests, connections, reports, and profile photo. This action is irreversible.

    You may also request account deletion by contacting us at support@gurby.app.

    5. Community Features and User Conduct

    5.1 Community Profile

    By creating a community profile, you make certain information publicly visible to other signed-in users, including your display name, occupation, profile photo, country of origin, migration status, city, and age. You are solely responsible for the information you share in your profile.

    5.2 Contact Requests

    You may send contact requests to other users with an optional introductory message. Contact requests are subject to rate limiting (maximum 10 per 24-hour period) to prevent abuse. When accepting a contact request, you may include an optional response message. When a contact request is mutually accepted, both users' private contact information is shared securely. All messages submitted with contact requests (both introductory and acceptance messages) are subject to automated content moderation.

    5.3 User-Generated Content

    You are solely responsible for all content you create, upload, or share through the App, including your profile information, profile photo, messages sent with or in response to contact requests, feed posts, comments, and reactions ("User Content").

    By submitting User Content, you represent and warrant that:
  • You own or have the necessary rights to the content
  • The content does not violate any third party's rights, including intellectual property, privacy, or publicity rights
  • The content is accurate and not misleading
  • The content complies with these Terms and all applicable laws

    • 5.4 Prohibited Conduct

    You agree not to:
  • Create a profile with false, misleading, or impersonating information
  • Upload profile photos that are obscene, offensive, violent, or that contain nudity
  • Send harassing, threatening, abusive, or spam messages through contact requests
  • Use the community features for commercial solicitation, advertising, or promotion
  • Attempt to collect personal information from other users beyond what is shared through accepted contact requests
  • Create multiple accounts to circumvent blocks, rate limits, or other restrictions
  • Use the App to stalk, harass, bully, or intimidate other users
  • Share another user's private contact information without their consent
  • Use automated tools, bots, or scripts to interact with the community features

    • 5.5 Reporting and Blocking

    You may report users who violate these Terms or engage in harmful behavior. Reports are reviewed by our team. You may block any user at any time, which prevents them from contacting you and removes any existing connection.

    We reserve the right to:
  • Remove any User Content that violates these Terms
  • Suspend or terminate accounts that violate these Terms
  • Take any action we deem necessary to protect the safety of our users and community

    • 5.6 No Guarantee of Connections

    We do not guarantee any particular outcome from using the community features. We are not responsible for the behavior of other users, the accuracy of their profiles, or any interactions that occur between users outside the App.

    6. Intellectual Property

    6.1 Our Content

    The App and its original content, features, and functionality are owned by Gurby and are protected by international copyright, trademark, and other intellectual property laws.

    This includes but is not limited to:
  • App design and user interface
  • Text, graphics, and images
  • Checklists and guides
  • Mascot characters and branding

    • 6.2 License to Use

    We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

    6.3 Restrictions

    You may not:
  • Copy, modify, or distribute the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Remove any copyright or proprietary notices
  • Use the App for any commercial purpose without our permission
  • Scrape, harvest, or extract data from the App

    • 6.4 Your Content License

    By submitting User Content to the App, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the App's features. This license ends when you delete the content or your account, except where your content has been shared with other users (e.g., contact request messages already delivered).

    7. User Feedback

    If you provide feedback, suggestions, or ideas about the App ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free license to use, modify, and incorporate such Feedback into the App without any obligation to you.

    8. Prohibited Uses

    You agree not to use the App to:
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit viruses, malware, or harmful code
  • Interfere with the App's functionality or security
  • Attempt to gain unauthorized access to any systems or other users' accounts
  • Use the App in any way that could damage or impair it
  • Collect or harvest information about other users through unauthorized means
  • Circumvent any rate limits, security measures, or access restrictions
  • Impersonate any person or entity, or falsely claim an affiliation with any person or entity

    • 9. Push Notifications

    The App may send push notifications about contact requests, accepted connections, reactions to your posts, comments on your posts, and other community activity. You can manage notification preferences for different categories (contact requests, new arrivals, community activity, and digests) within the App. You can also opt out of all push notifications through the App or your device settings at any time.

    10. Third-Party Services

    The App may contain links to third-party websites or services (such as government websites, banks, or service providers). We do not control and are not responsible for the content, privacy policies, or practices of third-party sites. Your use of third-party services is at your own risk.

    The App uses third-party services including Google Firebase, PostHog, and Sentry for backend infrastructure, analytics, and error tracking. Your use of the App is also subject to the terms of these services as described in our Privacy Policy.

    11. Disclaimer of Warranties

    THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF INFORMATION
    • We do not warrant that:
  • The App will be uninterrupted, secure, or error-free
  • The information in the App is accurate, complete, or current
  • Other users' profiles or information are accurate or truthful
  • Defects will be corrected
  • The App is free of viruses or harmful components

    • Information Accuracy

    While we strive to provide accurate and up-to-date information about Dutch regulations and procedures, laws and requirements change frequently. Always verify information with official sources such as:
  • Dutch government websites (rijksoverheid.nl, gemeente websites)
  • Immigration and Naturalisation Service (IND)
  • Tax authorities (Belastingdienst)
  • Healthcare authorities

    • Community Interactions

    We do not screen, verify, or endorse users or their profiles. We are not responsible for any disputes, harm, or losses arising from interactions between users, whether within or outside the App. Exercise caution and good judgment when communicating with and sharing personal information with other users.

    12. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, GURBY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, or goodwill
  • Any damages resulting from reliance on information in the App
  • Any damages arising from your use or inability to use the App
  • Any fines, penalties, or legal issues resulting from following the App's guidance
  • Any damages arising from interactions with other users
  • Any unauthorized access to or alteration of your data

    • OUR TOTAL LIABILITY SHALL NOT EXCEED EUR 50.

    Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

    13. Indemnification

    You agree to indemnify, defend, and hold harmless Gurby and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:
  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any User Content you submit through the App
  • Your interactions with other users

    • 14. Termination

    14.1 By You

    You may stop using the App at any time. You may delete your account from within the App (Settings > Delete Account), which permanently removes all your data. Alternatively, you may request account deletion by contacting support@gurby.app.

    14.2 By Us

    We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms or engaged in conduct harmful to other users or the community.

    14.3 Effect of Termination

    Upon termination:
  • Your license to use the App ends immediately
  • Your profile will no longer be visible to other users
  • Provisions that by their nature should survive will remain in effect (including Sections 6, 11, 12, 13, and 15)

    • 15. Governing Law and Dispute Resolution

    15.1 Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

    15.2 Dispute Resolution

    Any disputes arising from these Terms or the App shall be resolved through: 1. Good faith negotiation between the parties 2. If negotiation fails, binding arbitration in accordance with Dutch law 3. The courts of Amsterdam, Netherlands shall have exclusive jurisdiction for any matters not subject to arbitration

    15.3 Class Action Waiver

    You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

    16. Changes to Terms

    We may update these Terms from time to time. Changes will be effective when posted in the App. Your continued use of the App after changes constitutes acceptance of the new Terms.

    We will make reasonable efforts to notify you of significant changes through the App or other means.

    17. Severability

    If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

    18. Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gurby regarding the App and supersede any prior agreements.

    19. Waiver

    Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.

    • 21. Apple-Specific Terms

    If you are using the App on an Apple device, you also agree to the following:

  • These Terms are between you and Gurby, not Apple Inc. ("Apple")
  • Apple has no obligation to provide maintenance or support for the App
  • In the event of the App's failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) of the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection laws.
  • In the event of any third-party claim that the App or your use of the App infringes that third party's intellectual property rights, Gurby, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

    • 22. Google Play-Specific Terms

    If you downloaded the App from Google Play, you also agree to:
  • Google Play's Terms of Service
  • The App complies with Google Play's Developer Program Policies, including requirements for user-generated content, user data handling, and account deletion
